Welcome to getquickprints.com. Unik Printers Pvt. Ltd., the website owner including its subsidiaries and affiliates ("getquickprints" or "we" or "us" or "our") provides its website and related services ("Site") to any visitor to the website ("user") (cumulatively referred to as "you" or "your" hereinafter) subject to the following user agreement ("Agreement"). If you do not agree with any of the terms and conditions contained in this Agreement, please do not access or use this Site or any information contained on this Site. Use of this Site by you shall be deemed to be your consent to abide by each of the terms set forth below. TERMS AND CONDITIONS
1. User Account, Password, and Security
You will receive a password and user account upon completing the registration formalities. You shall be responsible for maintaining the confidentiality of the password and user account including all activities that may occur under the said user account. You agree to (a) immediately notify getquickprints of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.
2. Terms of use
These terms and conditions govern your access and use of this Site. By accessing or using this Site you agree to be bound by these terms and conditions and to any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this Site. getquickprints reserves the right to make changes to this Site and to the terms and conditions at any time without prior notice. You should review this Agreement each time you access this Site.
3. Copyright in material
Our Site contains graphics, photographs, images, document layouts, artwork, text, fonts, software tools, and other information relevant for undertaking the transaction ("Content"). All Content is protected under applicable copyright, trademarks and other proprietary rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site is strictly prohibited. getquickprints reserves the right to add to, delete from, or modify any part of the Content at any time without prior notice. You do not obtain any right or claim to any of the individual constituents of the Contents i.e. logo design elements through your creation of a logo design and/or your incorporation of a logo design into one or more products. Other getquickprints users may use the design tools to create logos that have similar or identical combinations of these elements and getquickprints does not guarantee that your logo will not have similarities to logos designed and used by other parties. getquickprints provides no warranty of any kind that logo designs created using the design tools will not infringe, or be subject to a claim of infringing, the trademark or other rights of another party. It is solely your responsibility to obtain the advice of an attorney regarding whether the logo design is legally available for your use and does not infringe the rights of another party.
4. Site and product use
You are granted permission to access and use this Site and its Content for the sole purpose of preparing, evaluating, and ordering products or services solely through getquickprints No other download, retention, use, publication, or distribution of any portion of the content is authorized or permitted. Without limitation, no portion of Content may be utilized as a trademark or service mark, for any pornographic use, for any unlawful purpose or use, to defame any person, to violate any person's right of privacy or publicity, to infringe upon any copyright, trade name, trademark, service mark or other intellectual property right of any person or entity. You agree that you will not use this Site to produce products that are offensive, unlawful, harassing, libelous, threatening, harmful, obscene, malicious or otherwise objectionable. getquickprints may terminate its service to users if found to be using getquickprints to engage in undesirable activities. You are solely responsible for your use of Content in combination with any other images, graphics, text or other materials you incorporate into your products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have obtained the appropriate authorizations from the owners. You may add new pictures and logos or modify the templates to create designs. We may delete these designs from time to time if it's not used for a very long time. We shall purge them from time to time. Also, it can happen that by system error certain designs can get deleted. Though it's highly unlikely, but incase this happens getquickprints shall not be held liable for such omission or deletion. You agree that you have all required rights or permissions necessary to incorporate third party material into your products. By placing an order on this Site, you warrant that you have all necessary permissions, right and authority to place the order. You are granted a non-exclusive, non-transferable, revocable license (a) to access and use the Site strictly in accordance with the Agreement, (b) to use this Site solely for internal, personal, non-commercial purposes; and (c) to print out discrete Content and materials from this Site as permitted by us solely for internal, personal, non- commercial purposes. You agree that you are responsible for protecting your password and controlling access to your registered account. You agree that you will be responsible for all orders placed or other actions that are taken through your registered account.
5. Purchases
You represent and warrant that if you are purchasing something from us, that (i) any credit information you supply is true and complete; (ii) charges incurred by you will be honoured by your credit card company; and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes, road permits or entry tax in your respective State. getquickprints under no circumstances will be responsible for getting this permit, and will not be liable for any delay or damage caused to the product due to delay in getting the permit.
6. Payment
Payment will be made 100% in advance. After confirmation receipt of payment mode, the select order will be processed.
7. Cancellation
Orders once placed will not be cancelled irrespective of the circumstances. This is due to the nature of work ‘Printing’, which is irreversible once commenced.
8. Refund
Under no circumstances, payment will be refunded either partly or fully, after confirmation of order and payments received. In case of ‘variations’ or ‘disputes’, refer to points 13 and 21 for clarity.
9. Third Party Content
Third party Content and materials may appear on the Site or may be accessible via hyperlinks from the Site. getquickprints is not responsible for and assumes no liability whatsoever for any loss or damages arising or accruing to you on account of any mistakes, misstatements of law, defamation, omissions, falsehood, obscenity, pornography or profanity in the statements, opinions, representations or any other form of Content and materials appearing on this Site or accessible via hyperlinks from this Site.
10. Shipping & Delivery Policy
For all buyers, orders are shipped through our arranged courier companies and /or speed post only. Orders are shipped as per the delivery date agreed at the time of order confirmation and delivering of the shipment subject to Courier Company / post office norms. getquickprints is not liable for any delay in delivery by the Courier Company / postal authorities and only guarantees to hand over the consignment to the Courier Company or postal authorities as per the delivery date agreed at the time of order confirmation. Delivery of all orders will be to the addresses provided by the buyer. getquickprints is in no way responsible for any damage to the order while in transit to the buyer.
11. Transfer of title
Once we deliver your product to the shipping industry the risk of loss and title for such items pass to you upon our delivery to the carrier. For any product that is to be provided to the user in an electronic format, the user agrees that delivery of such product shall be deemed to have occurred either (a) at the time we transmit the product via email or other electronic communication addressed to the user or (b) at the time we transmit a notification to the user that the product is available for downloading from this Site.
12. Privacy Policy
Your privacy is very important to getquickprints. Users of this Site should refer to our Privacy Policy ("Privacy Policy") for information about how getquickprints collects and uses personal information. By accepting this Agreement you expressly consent to getquickprints' disclosure and use of your personal information as described in the Privacy Policy.
13. Reservations
All orders are subject to acceptance by getquickprints. We reserve the right to reject any order at any time without recourse. We also reserve the right to change the price at any time even after we receive the order.
14. Acceptable Variations
At www.getquickprints.com we will deliver the exact quantity of goods for the order placed. However due to print processing the amount may vary. The generally accepted practice in the industry is a variation of plus or minus 10%. Due to difference in machinery, inks, paper and other conditions, there may be a minor variation between color proofs approved and the final finished products(as per generally accepted trade methods In the industry). Such variations shall be considered to be normally accepted. Please note the size of your final print may be 1/16 of an inch smaller than ordered by you. This may occur due to the difference in size of blade used. At getquickprints.com we do not make any changes in the files uploaded by the customer. Please check for spelling or grammatical mistakes. Also we are not liable for any wrong cuts, die lines, cracks in folds, missing folds or damaged fonts in the customer files. Due to the nature of the product, no returns can be made once the order is processed and/or shipped. Any claims for defects, damages, or shortages must be made in writing within two (2) business days after receipt of the merchandise. We will replace only those orders that were processed incorrectly. The replacement of the order will take place only after the receipt of returned merchandise. We will not replace the order if it is determined by us that the order was misused or mishandle by the buyer or part of the order was used by the buyer and part of the order is being returned.
15. Credit Card
If the Buyer's credit card is declined, getquickprints will not process the Buyer’s order and any charges incurred in the process will be borne by the buyer.
16. Indemnification
You agree to indemnify, defend and hold getquickprints and its partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, attorneys, advertisers, product and service providers, and affiliates, harmless from any liability, loss, damages, claim and expense, including reasonable attorneys' fees, related to your violation of the Agreement or use of this Site.
17. Disclaimer of warranty
You acknowledge that operation of this Site may not be uninterrupted or error free. References and links to products or services of independent companies may appear on this Site. These links and references too are provided without warranty of any kind, either expressed or implied. In no event shall getquickprints be held liable for any direct, indirect, punitive, incidental, special, consequential damages resulting from: (a) the use or the inability to use the services; (b) any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of this Site or service. Neither shall getquickprints be responsible for the delay or inability to use this Site or related services, or for any information, software, products, services and related graphics obtained through this Site, or otherwise arising out of the use of this Site, whether based on contract, tort, negligence, strict liability or otherwise. Further, getquickprints shall not be held responsible for non-availability of this Site during periodic maintenance operations or any unplanned suspension of access to this Site that may occur due to technical reasons or for any reason beyond getquickprints' control. The user understands and agrees that any material and/or data downloaded or otherwise obtained through this Site is done entirely at their own discretion and risk and such user shall will be solely responsible for any damage to his computer systems or loss of data that results from the download of such material and/or data. All responsibility or liability for any damages caused by viruses contained within the electronic file containing a form or document is disclaimed.
18. Limitation of liability
In no event shall getquickprints or its licensor, suppliers, vendors, subsidiaries, affiliates, directors, agents, officers, employees be liable for its own negligence or any special, incidental, consequential, direct or indirect damages of any kind, or for any damage of any kind resulting from the loss of profits, goodwill, use, data or other intangible losses whether or not, getquickprints has been advised against the possibility of damages arising out of or in connection with the use or performance of this Site, or of failure to provide products or services that you order from getquickprints or its affiliates, including without limitation, damages arising from mistakes, delay, omission, virus, or interruption of service. In no event shall getquickprints be liable or responsible for any damages or consequences arising out of or from your inappropriate or unauthorized use of this Site or its Content.
19. Site-feedback / comment / blogs
Any feedback, comment, blogs etc. provided by the user and received by getquickprints shall constitute non-confidential information. By submitting any such information to getquickprints, you agree that you are transferring and assigning, at no charge, all of your right, title and interest in the information, including all copyrights and other intellectual property rights. You agree that getquickprints shall be free to use such information on an unrestricted basis.
20. Termination
You agree that getquickprints may suspend, terminate or remove your password, account, material you may have contributed (or any part thereof) or use of this Site or any service if it believes, in its sole and absolute discretion that you have breached any of the term and conditions of this Agreement. getquickprints may delete any content or other materials relating to your use of the service and getquickprints will have no liability to you or any third party for doing so. You shall however be liable to pay for any service or product that you have already ordered till the time of termination.
21. Acceptance of agreement
The user hereby confirms its acceptance to the terms and conditions hereof, and confirms that he has read and fully understands the privacy policy and terms of services of getquickprints in respect of this Site.
22. Dispute resolution and governing law
You hereby consent to the exclusive jurisdiction of the Courts at Mumbai in respect of any disputes arising in connection with this Site, or any provisions of the Agreement or any matter related to or in connection therewith.
